I have a question regarding disconnecting past due monitoring accounts. If a client is past due (starting at 90 days), is it sufficient to send a disconnect notice via email from our software program, or is it the legal way to send via certified mail. Susan ******************** Response ******************** It's a good question. Because you use Kirschenbaum Contracts TM I know that you are not required to send letters by certified mail; you won't find that obligation imposed on you in any of the contracts. You are permitted to terminate a contract if your subscriber is in default. I have often counseled that I prefer you continue monitoring once you have sent the contract to K&K Collection Department. The reason is that we often get defenses that the system wasn't working. I also counsel that you obtain the Alarm History Report, or Activity Report from your central station so you will have proof that the system was working. Of course if you know it's not working then you may as well cancel the monitoring. Check with us once we have the case. You probably know that when you cancel fire alarm monitoring you most likely need to notify your AHJ, typically the Fire Marshal, in advance of the termination. You should also let your subscriber in on the good news that it will need Fire Watch. When you cancel be sure to make your notice unequivocal; do not make it conditional on anything, such as payment. The notice is to terminate, to fix a date and time of day, and that is the precise time you should cancel monitoring service. Do not provide service after your termination date and time because you no longer have a contract to rely on. When and how to terminate service is often dependent on several factors and therefore you shouldn't really have a blanket method or policy that applies in all cases.
