Group meeting conducted by Ken Kirschenbaum *********************** what expenses are covered by Service Plan *********************** Ken Are we required to cover lift rental costs for service calls covered by a Service Plan? Occasionally, we run into a customer whose service request on-site requires us to rent a lift to fix the issue. The opinions are divided here on whether that’s a cost we can pass on to the customer, or should we cover it because the customer has a service plan. Thanks, Ryan ************************ Response ************************ That is a great question and of course covers more than lifts; it might cover many different types of gear needed to perform a service call. Keep in mind that it's your Service Plan; you can word it any way you want. While the printed contract form does have many conditions and limitations it won't cover every situation you may face out in the field. That's what the Schedule of Equipment and Services is for, to change or explain items not clear in the printed form contract. For example, obsolete equipment is not covered. When you agree to provide repair service to a system [and I suppose inspection service would have similar issues] presumably you have surveyed the system and know what you are committing to. You can't, for example, agree to a Service Plan covering all labor and material for $30 a month only to end up having to service a system with 100 cameras and loads of other components. You need to price the repair service properly. For older accounts you may be able to rely on the service history; for new accounts you need to consider the warranty, newer equipment and anticipate what servicing the system looks like over the term of the Service Plan. To prepare this response I checked the Commercial All in One, particularly the provisions for the Service Plan. I recall that the contract did at one time have a provision that you were not required to service components more than 10 feet off the ground. That provision is not in the Commercial All in One [it may be in the Fire Protection All in One]. If you survey a system and see that you will need a ladder you don't typically have on the truck, or a lift, or any piece of equipment that you don't typically have available, you need to make a provision excluding those items from your Service Plan; if you don't then I think you will be expected to service the system, and that is your problem, not the subscribers. A perhaps more common issue might be your subscriber's location in relation to your office and routine operating territory. You can't enter into a Service Plan, collect RMR for who knows how long, and then decide that the subscriber needs to pay a "travel charge" because the account is now [or always was] outside your service territory. And yes, these are the kind of issues I see routinely that cause a subscriber's non-payment leading to a collection matter. Sometimes the alarm company is wrong. ***************** Webinars: All webinars were recorded and available on the K&K website at https://www.kirschenbaumesq.com/page/alarm-webinars and are available on Podcasts at https://podcasts.apple.com/us/podcast/ken-kirschenbaum-presents/id1794851477 *************************** STANDARD FORM AGREEMENTS: To order up to date Standard Form Alarm / Security / Fire and related Agreements click here: www.alarmcontracts.com *************************** CONCIERGE LAWYER SERVICE PROGRAM FOR THE ALARM INDUSTRY - You can check out the program and sign up here: https://www.kirschenbaumesq.com/page/concierge or contact our Program Coordinator Stacy Spector, Esq at 516 747 6700 x 304. *********************** WEBINARS: https://www.kirschenbaumesq.com/page/alarm-webinars *********************** ALARM ARTICLES: You can always read our Articles on our website at www.kirschenbaumesq.com/page/alarm-articles updated daily ******************** Wondering how much your alarm company is worth?
