Start and completion dates
**********************
Ken,
My team is asking about removing start/complete dates from our agreements as we are busy and when clients sign but don't send their deposit in, we wait for their deposit before processing a job and this can sometimes take 1-2 weeks, this means that the dates on the agreement are already old.
What is the significance of the start/complete dates and could we remove them if we wanted? What impact would that have?
Thank You,
Ryan

Like just about every provision we have in the Kirschenbaum Contracts™ we include provisions that are required by law or are worded in accordance with court decisions enforcing the provision.  This is the primary reason we have different contracts for different states; the law and court decisions are not uniform from state to state.
Start and completion dates may seem like a reasonable provision to have in the contract, but the real reason it’s there is because most states require it in a consumer [residential] contract.  Before removing the provision you should check with our Contract Administrator Eileen Wagda at 516 747 6700 x 312 or EWagda@Kirschenbaumesq.com to determine if it’s required in your state in the consumer contract.
The Standard Form Agreements modify the start and completion dates by making it clear that those dates are not “time of the essence” and also that delays are not chargeable against you.  If you agree to special arrangements for install or service you can make that note in the Schedule of Equipment and Services or on the Service Ticket.
