Whatever you hope to accomplish by the end of year needs to be focused on now, not last minute. What prompted this article was the thought of getting your accounts receivables current. That might mean making a few painful decisions about dumping subscribers who aren't paying for your services. Years ago I realized I could have all the clients I wanted if I was willing to work for free; same goes for you. No point carrying a subscriber who hasn't paid you and doesn't intend to. A lot of businesses in trouble try to hang on until the end of the year. If you have moved on from service provider to creditor then it's time to enforce your contract. If your subscriber falls out of its routine cycle for payments it's a problem that needs immediate attention. Only in the rarest cases should you tolerate arrears in the 60 day column and 90 days should be a cut off. While some internal dunning and collection effort is OK, you need to be careful not to cross the line. Giving your subscriber that you are bluffing and ultimately not going to do anything about the arrears, or taking too aggressive approach, won't work and can make more effective collection efforts futile. Subscribers who have developed a genuine dislike of you or your staff will be more resistant to reinstatement, curing the arrears, or paying. Your collection staff does not have the experience or success expectation as K&K alarm department staff, from its highly trained and experienced paralegals to attorneys. To get a matter started contact Kathleen Lampert at 516 747 6700 x 319 or KLampert@Kirschenbaumesq.com. Kathleen will acquaint you with the K&K process for pursuing your subscribers who are in breach of their contract. K&K offers collection support only if you have K&K Contract. The K&K Contracts typically call for you to recover 100% of what's owed at time of breach, 80% of balance of contract, 80% of retained equipment agreed value, legal fees and costs. The proceeding usually involves arbitration and is designed for cost effective and speedy resolution of dispute. Pursue your subscriber while it is still in business, not after it has liquidated and disappeared. When in doubt, contact Ken Kirschenbaum directly if you're a Concierge Client.
