ONE SUBSCRIBER WITH COMMERCIAL AND RESIDENTIAL LOCATIONS

    I have an existing customer with a construction company and three different locations. One location being his home with a home office. All 3 locations have alarm and CCTV.  Should I have separate contracts for each location or one for all three. He pays for all three from the business.

    You certainly need to use the Residential All in One for the residence.  You should use the Commercial All in One for the commercial jobs and it would probably be easier to have a separate contract for each location, even if it is the same subscriber.  As far as accepting payment with one check, that's fine.

CANCELING 2G SUBSCRIBER

We’ve encountered a customer who is one of our final 2 accounts on a 2g radio.  We have made attempts to provide the new radio but the customer refuses to sign a new agreement.  He is currently going month to month and states he will not sign a new agreement.   I know you have addressed month to month issues before but was curious if there was anything specific for Texas as to process for cancelling someone who is month to month who will not allow us to upgrade the radio.  We know this 2 g will fail to operate soon.

    All you need do is give 30 day notice that you are not renewing the contract.  Nothing special in Texas for this cancellation.  
    We can make the question spicer by changing the facts.  Let's say you're in the middle of a 5 year agreement.  You know the 2g system is going to fail and your subscriber won't allow you to update.  In that case you can advise the subscriber that the system is going to be obsolete and since the subscriber won't allow an update you are canceling service.

    Got a question.   One client is not interested in doing the ACH/CC automatic billing month-month.  He wants us to bill him every month with an invoice (lot’s of work for us).  We’re thinking of billing him in advance on an annual basis to ease the workload.  Thoughts?

    This is a business decision, not legal.  Though the contract we send you may include ACH and credit card spots you are not required to get that information to have an enforceable contract.  If you are a "mass" marketer with numerous installations and all your accounts are required to agree to ACH or credit card payment then you may not want to get involved with a handful of subscribers who aren't going to cooperate.  Also, you may be selling off your subscribers [now or in future] and your buyer may only be interested in accounts with automatic payment processing.  Automatic payment processing could also influence the multiple you may get on a sale.
PS - the alarm co decided to bill the sub annually, in advance.
