nursing home cameras detecting fall
*********************************
Ken
We are working with a video manufacturer who has developed an AI technology on a hemispheric camera to detect if a person at a nursing home falls on the floor or falls out of bed. I know we can't place cameras in areas with an expectation of privacy, like a bedroom or a bathroom.
How do we find out which states will allow video recording or not for this type of application? I know there are exceptions for certain types of facilities. For example, we can install magnetic locks that prevent egress out of a building for a memory care facility but can't for all other types of buildings because of the fire code. I am curious if exemptions exist for this type of application in hospitals or nursing homes.
I look forward to your response.

You can start your inquiry on the K&K website under Alarm Law issues:  Audio – Video Statutes state by state: https://www.kirschenbaumesq.com/page/alarm-law-issues
While there may be certain laws in your state specifically exempting prohibitions of audio or video placement, the purpose and intent of the placement and the environment will be a factor.  Obviously, someone in need of 24/7 supervision has no expectation of privacy and may need to be under supervised watch, video and audio at all times; this would necessarily override prohibitions in normal or other conditions.
You would be using the Commercial All in One for camera and audio devices in the type of facility you refer to.  The All in One puts the onus of legal use on the subscriber, and there is a full indemnity from the subscriber.  It’s the subscriber who needs to get its attorneys to opine on device and placement legality, and that’s what the All in One provides.
