I had interesting experience today.  Just about every day I get a call from an alarm company asking that I "look over" some changes made by a subscriber or subscriber's lawyer, and often I am asked to negotiate the changes so a deal that doesn't leave the alarm company overly exposed can be made.  These calls come from all over the country, so what made today a bit different was that the calls were from alarm companies local to my office.  I know the alarm company owners well and they both have easy access to me; they both get the emails and I do corporate and other work for them.

What caught my attention was the outdated contracts these guys were using, and in one case, a commercial fire alarm was contracted using a residential contract form.  I told both guys they needed to upgrade their contracts. One said he would today, but didn't, and the other said he couldn't afford to but we would discuss it when he got back from vacation.  Apparently these guys don't understand that their contracts are the most important part of their business.

Why are you working in this industry?  There is immediate cash flow, build up of recurring revenue and ever growing equity in your business.  At least that's how it's suppose to work.  What do you think is going to ensure that you collect the bargain you make with your subscriber?  What do you think you're going to rely on to defend against a claim that a subscriber suffered a loss (and don't think that it's not going to happen)?      What do you think you're going to have to sell when it's time to sell?  If you guessed that the answer to one or all three questions is your good looks, you're wrong.  In fact I'd sort of like to see how you look when you need to address one of these questions and you don't have a proper contract.  Distraught.  That an emotion or a physical description, or both?

There is a reason your central station wants you to have proper contracts in place; why your insurance company wants you to have proper contracts and why a potential buyer wants you to have proper contracts (unless of course your buyer would prefer to pay you peanuts and then go out and sign your subscribers to proper contracts).

I guess I wouldn't be surprised if I'd heard from some guy (like I do too often) that starts with "so and so recommended me to you" to which I ask, "have you ever heard of me" and when he responds "no" I expect that he doesn't have proper contracts and plenty of other legal issues.  Sort of like you having a sign on your building that you're in the alarm business, trucks with your name parked around all the time, and your commercial neighbors comes in to tell you that he just got burglarized and maybe, what do you think, should he get an alarm system put in?

I don't get to rant on here that much, so please excuse today's rant.

BTY, I am going to schedule Webinars this month to go over the All in One contracts.  These include the Residential All in One, Commercial All in One, Commercial Fire All in One and the new Fire Suppression All in One.  So save up.  It's time to update your contracts if you're copyright is not in 2013.  Call our Contract Administrator Eileen Wagda if you're not sure.  Her number is 516 747 6700 x 312.
