    We recently sent out the monitoring contracts you wrote for us. While we have a received a good amount back, many of our commercial customers won't sign for reasons such as the one below. If we were to take out the phrase “The undersigned personally guarantees subscriber’s performance of this agreement”, would there be something better to replace it with that is more appropriate for a business?

    The Standard Form Agreements for commercial use [and you should be using the Commercial All in One or Fire All in One if you do commercial fire ] include a "personal guarantee" provision.  That guarantee is not necessary for a complete binding agreement, but it does personally bind a person, usually an officer of the entity who is your subscriber.  To have an effective guarantee the agreement will need to be signed twice, once by the subsciber and once by the guarantor.  Including a provision in the agreement that the person signing is also guaranteeing is usually not enforced.

    We have started emailing customers a pdf of your contract for them to sign, esign or digital sign and return.  Even though we include instructions for the Adobe esign, most customers just print the last page, sign it and fax or scan that last page back.  We have asked them to send back the whole thing but that is annoying some.  We wonder if just signing the last page and sending is sufficient.

    It's not.  You need the full document.  Send them a self-addressed stamped envelope and ask them to mail the contract back, and when you send to them electronically make sure you send as a single document so they print out the entire document.
