This comment [see below] on classification of employees vs. independent contractors is definitely is a wake up call for all companies, I am wondering if anyone has had any experience on either side of the equation and can share it here in this forum.

Here is an interesting site I came across the other day http://communications-contractor.com that can financially cripple a company that misclassifies much more than several thousand dollars and its Federal issues applies to everyone in the United States. It tells how a contractor can file simple paperwork with the IRS and receive thousands of dollars which the company must pay back with interest and penalties. Its a "must read" for any person or company who classifies anyone as a contractor/subcontractor.

terminating problem accounts

Ken,

I have had only a few problem accounts over the years, and almost all of

the time the contract term is over. How best do I terminate our

relationship? I don't see anything in the contract covering this.

The problem is that your relationship should be over the minute the contract expires. You don't want to be providing any alarm services without a contract. Once the contract is over you are providing service on an at will basis and without contract protection. Neither you nor the subscriber are obliged to continue the relationship and either can terminate at any time. Because you are providing security services I suggest that you give some notice of termination of your services. Letter, email, fax, phone call or even message on the keypad. Make sure the notice is unequivocal, which means there is no option for the subscriber to continue the service. Your notice is simple: you will terminate all services as of specific date and time.

If you are in a jurisdiction that requires that you notify the AHJ of termination of service make sure you comply with those requirements.
