Ken,
    Our California company always enjoys your emails keeping us in the know on current issues and concerns throughout our industry. One issue we keep personally dealing with is customers (mainly property management companies) coming back to us after signing our agreements and demanding that we sign theirs. However, their contracts include indemnification clauses that we are not comfortable with. This used to be a one-off situation in the past, but we are seeing it every month now and having to combat companies on what they want signed while they threaten nonpayment if we don’t sign their vendor agreements.
    Does Kirschenbaum offer help in this area? We were curious if there is a form that we can provide to these property management companies as a “letter of position” for lack of a better term that states what we won’t accept when it comes to liability. I hope I have explained myself well but would appreciate the opportunity to have a consultation with someone on the Kirschenbaum team regarding this to gain insight into a solution that works for our business.
    If you could point me in the right direction on whom to speak with, it would be greatly appreciated.

    The answer is really simple; the Concierge Program, which you have to have heard about, covers contract review, including the property manager or subscriber vendor agreement, in the monthly contract review free half hour.  In fact, most of the reviews I do on a daily basis, typically around 5 a day, are for property managers, including the worst, Cushman and Wakefield and CRBC [I think is their name].  That assistance alone is worth $4800 a year; the program is $1595 or $145 a month [6 month minimum].   As I was reading your email I was getting ready to tell you to make a payment on my website for $800 for up to an hour for review, or join Concierge Program.  
    BTW, heads up to you and others.  The cost for the Concierge Program is likely going to increase soon.  All existing Concierge Clients will be grandfathered at the current rate.  
    That's the smart move; smarter move is to use the program once you join.
