What started this was a customer that has several locations (Pharmacy) and can’t be at all locations when a problem comes up but wants us to be able to remote in right away to fix whatever we can remotely without getting any of his employees involved. Is there a form you recommend for a release of liability if things ever go south for any reason or does the All-in-One agreement cover us for this part of the service if we are doing all the inspections and remote monitoring under the All-in-One agreement. The remote service I’m looking at is AnyDesk and it appears to be the preferred way for remoting into our manufacturers camera systems but looks open ended to use with anything. Kindest Regards, Bob Stutesman, AET, President/CEO Integrated Security Solutions, LLC. Hastings, NE ************************* Response ************************* The Standard Form Agreements, supplemented by the Schedule of Equipment and Services, is sufficient to cover remote service, especially is you have it described in the Schedule of Equipment and Services. I reviewed the Commercial All in One and I thought that clarification and specific authorization was a good idea. I modified the contract and all the other Standard Form Agreements that provide for service will be modified and updated as well. The Commercial All in One was updated some time ago to cover Network Administration, and remote access is covered in that provision. But Network Administration can mean the customer's computer network, not the security system, or at least not exclusively the security system, and I don't believe all security systems or equipment are connected to the customer's computer or computer network, though I may share the Internet service at the premises. The Standard Form Agreements are designed to cover any and all the services you provide in connection with the described systems, installed by you or others. The contracts won't however cover work you decide to do that is clearly outside the scope of the security or fire alarm agreement. An example? Your service tech decides to lend a helping hand with a dishwasher connection resulting in extensive flooding, while he's standing there or once he left. No good deed goes unpunished. Thanks for raising this issue. It's a good example of why the K&K contracts are continuously being updated. ********************** STANDARD FORM AGREEMENTS: To order up to date Standard Form Alarm / Security / Fire and related Agreements click here: www.alarmcontracts.com *************************** CONCIERGE LAWYER SERVICE PROGRAM FOR THE ALARM INDUSTRY - You can check out the program and sign up here: https://www.kirschenbaumesq.com/page/concierge or contact our Program Coordinator Stacy Spector, Esq at 516 747 6700 x 304. *********************** WEBINARS: https://www.kirschenbaumesq.com/page/alarm-webinars *********************** ALARM ARTICLES: You can always read our Articles on our website at www.kirschenbaumesq.com/page/alarm-articles updated daily ******************** Wondering how much your alarm company is worth?
