Contract updates for Wisconsin

          So far we reviewed change in contract law in Michigan, Minnesota, New Mexico and Oklahoma that requires updating your alarm contract. 
          Today we do Wisconsin:  There are two changes.
          These changes to the K&K contracts affect consumer and commercial contracts.
Punitive damages:
          You should make sure that your K&K contracts do not limit damages for punitive damages. 
          See Cook v. Public Storage, (“With respect to punitive damages, we conclude the limitation of liability clause is unenforceable because it is against public policy. Punitive damages serve the public policy purposes of punishing wrongdoers and deterring others. Public Storage has not provided, nor have we found, any authority for the proposition that punitive damages may be limited by contract.”)
          While a court may cull out punitive damage from the contract damage provision(s) the better practice would be to remove reference to punitive damages. 
          What constitutes punitive damage or when it might be appropriate to assess punitive damages is beyond the scope of this article.  Suffice it to say that it would involve egregious conduct likely affecting the public at large [which in today’s world has a very wide view]. 
Limiting the statute of limitation:
          This is likely a change that needs to be made in your K&K contracts.  The contracts have a one year shortening of the statute of limitations for bringing lawsuits or arbitrations.  You cannot limit below the statute of limitation which will be for more than one year for contract or tort.  The sentence shortening the time to bring an action should be deleted from the contracts.
