    The attorney who requested the copy of the contract and insurance information should have been set straight in the dealers first response.  I personally handled about 400 instances exactly like this one totaling about $80M in alleged damages or other losses and I deflected all but two cases.  The attorney was on a fishing expedition and seems to have caught a big one.  And, as Ken stated, this will only cause more suits to be filed.  This was mishandled and Everest should have known better.

    This happened to me with a defensible case back in the 80's.  The carrier then sent me a bill for the $5000 deductible.

    A carrier's policy on handing claims should be important to you; it affects you and others in the industry because settling claims encourages more lawsuits.  While some claims should be settled, most should be defended and the integrity of the contract provisions supported and enforced; that will reduce the likelihood of subscribers and others suing alarm companies for losses when they believe security services could have lessened or prevented the loss.  Another problem is affecting your insurance claims history.  How that works can best be explained by your broker.

    I've had too many residential customers get divorced and fight over who is responsible for paying my bill... Now I won't move forward until both owners sign.

    Going after a husband and wife who default on the contract is the least of your problem.  Getting dragged into a marital dispute and ending up a ping pong ball is bad enough, but getting sued by the one who did not sign the contract will raise issues that you shouldn't have to deal with had you gotten the contract signed by both spouses.  It's the better practice.
