Space limited so be sure to RSVP if coming asap ********************* Considerations for homes intended for rental ********************* Ken If a homeowner plans to use their property for short-term rentals (such as Airbnb), but wishes to remain the primary user of the security service between guest stays — so that the short-term renters themselves do not have access to the security system — is this arrangement acceptable under the agreement if the homeowner is the user and signer? Additionally, if the system includes surveillance components (such as indoor, outdoor, and/or doorbell cameras), does this change the situation or raise any different considerations? name withheld ************************ Response ************************ Owner signs the agreement [could be commercial or residential] All in One. You would want to retain the indemnity and insurance procurement provisions. Also, tenants would not be able to deal with you or the central station; only the owner. They could arm and disarm if owner gives them the code and they can give a "all clear" response if the central station calls on a signal and they know the password. The tenant cannot call for service or to put the system on test, repairs or additions; only the owner. You could also suggest to the owner, your Subscriber, that the tenant's lease make it clear that the security system and fire alarm system, all systems, are there for the owner's protection, not the tenant. Your suggestion should be in the Disclaimer Notice, which will prove helpful if you have to rely on the Indemnity or Insurance provisions when the owner complains about having to defend you against claims by tenants that the systems didn't prevent loss. To change that the owner would need to incorporate, could be by reference, the All in One owner signed into the lease agreement. I'll confess I don't know how Airbnb arranges the tenancy, so not sure if owner would be wise to have some other document signed, a disclaimer essentially, that owner is not responsible for security. Thinking about it, the tenant probably does have a right to rely on a fire alarm system and other life threatening detection devices typically installed with the smoke and heat detectors in a residence, which is why the Indemnity and Insurance protection from the owner is so important.
