Regards, Ryan ***************************** Response ***************************** If you have contracted to install UL listed equipment then you would be in breach of contract if you installed equipment that did not have the UL listing. If there is a loss and that loss is attributable to equipment that should be UL listed and isn’t then you face additional issues because it’s likely a presumption will arise that you used inferior equipment. The implication, had you used the proper UL listed equipment the equipment would not have failed and there would have been no loss. I don’t know if Bosch panels were UL listed and now they are not. I also don’t know the consequence of equipment being UL listed when installed that later loses the UL listing. Would that have triggered a call-back; a manufacturer recall, one that you would be expected to communicate to the customer to whom you sold and installed the equipment? Since you believe the Bosch panel is no longer UL listed, and that UL listing was specified in the contract, it would be prudent to notify the customer of the need to upgrade. However, because this is a fire alarm system I suggest you check with the Fire Marshal, the AHJ, to see what they want done. ************************* STANDARD FORM AGREEMENTS: To order up to date Standard Form Alarm / Security / Fire and related Agreements click here: www.alarmcontracts.com *************************** CONCIERGE LAWYER SERVICE PROGRAM FOR THE ALARM INDUSTRY - You can check out the program and sign up here: https://www.kirschenbaumesq.com/page/concierge or contact our Program Coordinator Stacy Spector, Esq at 516 747 6700 x 304. *********************** WEBINARS: https://www.kirschenbaumesq.com/page/alarm-webinars *********************** ALARM ARTICLES: You can always read our Articles on our website at www.kirschenbaumesq.com/page/alarm-articles updated daily ******************** Wondering how much your alarm company is worth?
