Question:
Jennifer,
I've received a subpoena labeled "Decus Tecum". Now what? Do I have to go to court?
Appreciate your support.
Dr. M
Answer:
Hold up! Do not cancel cases! Do not stress. A Subpoena Decus Tecum is typically a request for medical records for which you are authorized, under HIPAA, to release. Very often the request is from a party, sometimes the government in a criminal matter, or third party in a matter not directly relating to you, where the medical record or other records you may hold are relevant to their main concern, but you are not a target. Often you can just remit the requested documents and the inquiry ends there. To ensure the inquiry is benign, always reach out and we can help you suss out the request.
