Question:

Jennifer,

Why does Venue in my vendor contracts matter?

Thanks in advance,
S.

Answer:

As you may know, venue dictates where an action may be brought - which the parties to a contract may agree upon in advance.  Venue is not just a convenience issue, which is of course a main reason to press on its own, but also a determinant of outcome in certain instances, for example, where a jury trial may be unavoidable.  For certain plaintiff friendly matters - personal injury, malpractice, divorce - venue may be a deciding factor.  For instance, money awards in the Bronx v. Nassau County are staggering different depending on the type of action.  You may see 5x the award for the same injury in the Bronx, as in Nassau County.
