New York State Alarm Installer license enforcement stepping up - have you gotten your letter yet?February 22, 2017

    NYS licensing division, Division of Licensing Services, DLS, is stepping up Alarm Installer license enforcement by conducting audits.  The audit letters are going out and you should not be surprised to get one.  The investigators are looking for technical violations that result in heavy fines.  Since the fines are cumulative they can be significant.  
    You should engage Kirschenbaum & Kirschenbaum to represent you in the audit investigation and sooner rather than later.  We should be the one responding to the DLS letter, not you.  We know what to look for and how to respond.  Once the inspector thinks you are non-compliant it's going to be an uphill battle to convince DLS not to fine you.
    We will have a telephone consult with you for $500.  If we think you are completely compliant then we may suggest you go it alone.  If however we identify vulnerable issues you should engage us to represent you in the audit.  Typically you will be required to advance a $1500 retainer that should cover you through the response to the audit letter and negotiations. You can start with engaging us and then the $1500 covers the initial consult.  If litigation is started by DLS our fees are hourly.
    Fines can run from $1000 to tens of thousands.  Further consequence can be suspension or revocation of your Alarm Installer License.  Based on questions from our clients let me address a few other issues.  The audit process is not something your accountant should handle nor any other professional that has no experience with license enforcement audits and enforcement.  If you call us after you have responded to the audit letter our minimum retainer will be $3000.
