How is this for a close call? A number of years ago I installed a burglar alarm in a service station. It was back when we were still using tape dialers. The service station closed at 12 noon on a Saturday. They armed the system and left for the weekend. Later on that day there was a horrific lightning storm. The building got struck by lightning, wiping out the alarm system. Around 1AM the next day (Sunday morning) a police officer while on patrol noticed a broken window on the front of the building. There was a van parked in front of the window, so it was somewhat hidden. The cop discovers the place had been burglarized. I get a call on Monday morning from the owner and he was quite upset. He told me about the burglary, and that my system didn't work. He said that he intended to sue me. I went right over to the station. As I walked in, I heard two of the employees yelling to the owner. One said "Yeah, the exhaust emissions analyzer isn't working either." A few seconds later the other employee says "these two phone lines are down too."
Obviously the lightning strike was an act of God. Even with today's systems that are much more immune to transient voltages, a direct or near lightning strike will damage anything electronic. At that time, I wasn't using your contracts, and although owner realized that there was no real culpability on my part, I still sweated it out for a few months. Shortly thereafter I became a believer in your "all in one" contracts.

Horror story. Don't think anyone was sued. The Flat Rock, Michigan county library sent in a flow alarm late at night. The police arrived and looked in the windows and did not see anything. Did not try to gain access. they left. Next morning the librarian found water coming out from under the door. Destroying hundreds of books.

Great subject matter for discussion. I thought I would share some of my own experiences. In some examples there appears no legitimate reason to sue the alarm company. In some others, yes they were negligent to some degree (grossly?) In 20 + years owning various alarm and security related businesses, I've yet to be sued. Often, the way of handling a situation can make all of the difference.
In other cases you just get lucky and hopefully learn. Here are some examples that could have turned very ugly, but didn't. Alarm Co. adds a passive holdup system to existing alarm for business that handles large amounts of cash.
Finished installing late, decides to send central the additional signal code description next day The following day was busy, alarm co. received a call prior to sending information to central Subs held up, tied up at gunpoint and pistol whipped. Just plain lucky they couldn't show the cash receipts and didn't sue. Alarm co. adds temperature monitoring to existing residential alarm for a vacation home
Installer forgets to contact central for additional signal code and description Heating fails two days later, pipes freeze and break ruining new carpeting and furniture Fast talking, refund of the temperature monitoring install and lost the account and the main house and business accounts. Alarm Co, Installs residential system. Two days after completion, notified that an expensive camera is missingAlarm Co. Had fired one of the installers the day of the call due to honesty concerns at another installation Contacted insurance company, answered questions honestly, insurance paid for the loss Alarm company lost the account, no out of pocket for alarm company Alarm Co. Installs commercial alarm for a retailer in seedy neighborhood.
Subscriber is held up, presses panic button Contacts alarm company, threatens to sue stating we never called police.
Central station provides audio tape of call, advising alarm co. should not provide to sub until it's subpeonoed.
Went to Subscriber, provided tape anyhow, subs attorney advised the him that alarm co. acted properly.
No lawsuit, happy client.
Alarm Co sends repair tech to find and cure reason for false alarms from a commercial alarm.
Subscriber is robbed that evening, suffers losses of about $2,000.00. alarm never went off.
Alarm Co owner investigates with the Tech questioning all of his work to find out that
Tech put a capacitor across protective circuit, which shorted out due to low voltage rating
Alarm Co fired Tech citing gross negligence and improper repair techniques (laziness).
Alarm Co installed a new alarm system at no cost to sub to avoid lawsuit.
There are others, and many attempted and stopped burglaries as well
Anybody that states they never had an issue or never made a mistake has not installed many systems or has not been in this business for any length of time.
