I employ a phlebotomist.  Does she need malpractice insurance?

Answer:

Well, some states the norm is not to carry malpractice insurance, but if you are in New York, or a state that has a very high incidence of malpractice suits, absolutely! Any member of your staff that is involved in patient care, and certainly patient touching, should be added to your malpractice policy or insured in their own right. Certain carriers have specific policies and market towards phlebotomy.  I recommend requiring she carry.
