Question:

Jennifer,

I'm looking to hire an NP that has her own blog, and I have agreed to pay her malpractice.  Do I have risk here?

Answer:

Your employment arrangement with your NP should be governed by contract, and in that employment contract you should explicitly carve out what she is performing as within the scope of her employment and what falls outside the scope of her employment.  If the blog is an outside activity, make it clear you are not taking on liability and require the employee indemnify you and the practice from exposure.  If the blog is resulting in patients coming to your practice and that is part of why you are hiring the NP, the contractual carve out may not be enough to limit.  

We should discuss and you definitely need a contract!
