Contract for Area of Refuge communications systems
**********************
Ken,
As a code enforcement official I find your postings most informative. Question for you. Many alarm companies also design, install and service two way communications systems in buildings. These systems are referenced in Chapter 10 of the International Building Code (IBC) and are often referred to as “Area of Refuge” communications systems. These are life safety systems designed to allow mobility limited persons to contact the lobby of a building and for those lobbies that are unattended to transmit voice and data to a central answering location to be retransmitted to first responders. Are these systems included in K&Ks contract offerings?
Sincerely
John Drucker (AHJ)

I’d like to thank John for his valuable contributions over the years to this forum.; thanks for raising this issue.
ARC systems are covered in the Fire All in One. The Area of Refuge two way communication systems is installed in conjunction with the building fire alarm. The Fire All in One could be used if you are installing only the ARC system.
Needless to say, fire alarm protection is most challenging and exposes the alarm company to unlimited liability for injury and death to persons and property damage and destruction; damage awards could easily be in the tens of millions of dollars. You would be, simply stated, pretty dumb to leave yourself exposed to that potential liability. For example, in the building collapse case in Miami Beach, Florida not too long ago the principal complaint against the alarm company involved the Area of Refuge communications systems.
You should be mindful that one purpose of the Kirschenbaum Contracts ™ is to keep you from getting sued in the first instance. Presumably anyone considering suing you will read the contract and realize a law suit will be futile. Plenty of subscribers [and more often their insurance companies exercising subrogation rights] will roll the dice and start a law suit against the alarm company no matter what’s in the contract. It’s not too uncommon for a law suit to be started by a subrogation carrier and they don’t even know about the contract. If you get involved in this kind of law suit you’ll be glad you have proper contractual protection.
Don’t miss the contract sale. The 2023 Kirschenbaum Contracts ™ are updated, current, and your best contractual protection against potentially devastating law suits. By the way, that’s the main reason the Kirschenbaum Contracts ™ bring the most value to your company.
