This is the first time I am aware of an arrest for selling illegal foreign cameras. I don’t know how popular these cameras are [I know they are in my home] but I suppose you need to be careful with your camera selection for particular customers, particularly government and government vendors. Thanks to Jim for sending this along, and even though I’m not Harvard’s president I’d like to be sure to give credit where due, so the author of the below is Ken Serrano who published in the Asbury Park Press on January 5, 2024. ********* A Toms River man who owns a Lyndhurst company that sells surveillance equipment like license plate readers and infrared cameras to New Jersey law enforcement agencies has been accused in a federal complaint of selling products from a banned company in China. Tamer Zakhary, 49, charged with three counts of wire fraud and one count of making false statements, appeared Wednesday before U.S. Magistrate Judge Edward S. Kiel in federal court in Newark and was released on $100,000 unsecured bond, prosecutors said. Zakhary is accused of violating the John S. McCain National Defense Authorization Act, passed by Congress in 2018 and meant to limit the ability of foreign governments to spy on the United States According to the Coalition for Government Procurement, a nonprofit association for commercial contractors, the law was passed to prevent cyber-attacks and "efforts to exfiltrate information and intellectual property" by spies. The complaint from the U.S. Attorney's Office in Newark did not name the partly state-owned Chinese company that Zhakari did business with but it did list some of the companies banned: Hytera Communications Corporation, Hangzhou Hikvision Digital Technology Company and Dahua Technology Company and their subsidiaries and affiliates, one of which is in California. The law prohibits the federal government from buying video surveillance and telecommunications equipment from certain Chinese companies. Zakhary's law enforcement customers purchased at least $35 million for products from Zakhary, with more than $15 million of it coming from federal funds and grants, some of it from COVID-19 relief funds, according to the complaint. Federal authorities did not say whether the equipment bought by police departments, sheriffs' offices, prosecutors' offices and others in New Jersey led to any breach in security. According to the complaint, Zakhary falsely told customers that his company’s products complied with the law. During an interview with FBI special agents, Khazari maintained that the products he sold were not banned because the blocked Chinese company did not produce the software associated with them, according to the complaint.
