 Question - Removing Yard Signs and Decals

Ken,

We have found our window stickers and yard signs on business’s and residential  homes that do not have our security system. Do we have any recourse to remove the yard signs/ window stickers from business’s and residential homes who does not have/ purchase our security systems?

May depend on how the decals and signs got there.  If a former subscriber had your system there and you placed the decal and sign it may be difficult to remove them, legallly.  If you never had a system in the premises and the decal and sign was installed by the end user or another alarm company you do have a right to remove it.  How you would remove a sign or decal is the problem.  You cannot breach the peace.  You cannot trespass on another's property.  

It helps if your yard sign and decal states that it is your property.  Your contract could exclude the decals and signs from the sale.  

Most alarm companies would be happy to see their decals and signs even in premises where they didn't have alarms.  Are the days of putting stickers on empty stores over?  

I don't believe you have any risk, exposure or liability because your decal or yard sign is placed on premises by another.  You are within your rights to request that they be removed.  If it's clear that you own the decal and sign you could commence an action for an affirmative injunction to require removal.  Hardly worth it in my opinion.

We had installed cameras on local businesses funded with neighborhood clubs donations to help deter crime with the capability for the local police district to connect normally if they have a problem or during an emergency call and only 1 or 2 officers have that capability, we installed large signs only as a deterrent, normally the business owners can only view and if they need a video they can contact us or the police department. For the past 5 years the cameras help convict many crimes including murder and vandalism, no one so far complains about the cameras and what they see.

Hi Ken,

There may instances where as a medical alert system or for a elderly parent, cameras may be installed in areas that are normally off limits where the video stream is only viewed by the adult children of that elderly person. This arrangement allows that elderly person to remain in the home where they wish to be verses being placed in a Nursing Home. I see nothing wrong with that arrangement as the video is kept strictly within the family.
