QUESTION:

Ken:

Is it legal for police agencies to install their own covert cctv devices. Recent emails have been dealing with the need to be licensed to install CCTV, are police agencies exempted from the law??

Thanks,we enjoy all of your emails and appreciate your good advice.

ANSWER:

You can read the laws pertaining to CCTV on my web site at http://www.kirschenbaumesq.com/avstatutes.htm

The statutes are state by state and the federal law.  These are audio and video laws.  If I'm missing any please let me know.  You will see that many states except law enforcement from the laws, for obvious reasons.  So my answer is that law enforcement need not be licensed if they engage in activities that would otherwise require a license.

I guess its not that much of a stretch for local police to decide that they not only want to monitor alarms, but now they want to install and service them.  And, they don't want to be burdened with having to get a license if one is required in that jurisdiction.  We're not there yet.  Keep an eye and ear open.
