Question:

    Hi Ken,
Quick question, if someone is renting a home. And the subscriber wants a home security system.  Is it up to the subscriber or the dealer to contact the landlord. Is it true that if the landlord is not contacted by either party, that the landlord could take legal action?? Thank you. Sean

Answer:

I assume that your subscriber is the tenant.  My standard contract has a provision that the subscriber, if not the owner of the premises, represents that it has the authority to install the security system.  Even without this provision, a tenant in possession of premises would have apparent authority, if not actual, to install a security system.  I don't think an owner could compel the security company to remove the system or seek damages, unless the property is damaged.
