Thank you to Todd Fass who specializes in No Fault representation, as well as several other areas of law) for providing the below in response to yesterday's email, available here

Jennifer,

Thanks for sending out yesterday on worker classification. Please let your readers know that for any professionals
who provide services to auto accident victims and bill no-fault insurance carriers they must tax their staff as W-2 employees and not independent contractors.  New York case law has interpreted the relevant regulation and does not permit medical providers to hire and bill for independent contractors.  In the event an independent contractor is utilized the carrier will pay said independent contractor directly, if at all.

If you or any readers have any additional questions, feel free to call me.

Regards,

Todd Fass
