    If we accept credit card payments by phone, and the customer asks us to charge his card automatically for his recurring billing, do we have to have that request in writing? Or is the verbal agreement and the giving of the card information good enough?

    You must have written authorization if you are going to charge your subscriber's credit card for recurring charges. You should also stop charging if your subscriber withdraws the authorization. Last thing you want is a charge-back from the credit card company. It's one thing to charge for services already rendered and accepted by the subscriber, and another if you hit the card for future recurring charges.

    For recurring transactions, you want to have their authorization on file, either through a written form or their consent through a web-form online. Signed contracts are especially important in recurring billing to help protect a business in the event of a charge-back. Your customer contract should include a clear explanation of how the recurring billing works, including when accounts are billed, what happens to the customer’s account in the event of repeated declines, and how the agreement can be terminated.
