COVERT CAMERA ISSUE

    I have a client whose husband is of failing health, bad physically and mentally.  The wife sleeps in another bedroom.  She wants to install a covert camera in the bedroom (living room etc) so she can ensure that the aid who is supposed to stay awake is fully supervising her husband, the aid does NOT sleep in the home.
    I want to know since the wife is the home owner, and she is consenting to have the camera installed in the bedroom, does that present any issues with an aid claiming that he had a right of reasonable privacy, she is NOT concerned about the husband causing any issues.

    The aid does not have any expectation or right to privacy in the home, except perhaps in his own designated bedroom and bathroom.  Your client is permitted to install video and audio.  You can and should be sure to add to the Residential All in One on the Schedule of Equipment and Services that "Subscriber has been advised to use the surveillance system lawfully".  It's not your responsibility to explain what "lawfully" means, so don't try.

    I have a new customer that would like to install cameras in their house to help keep an eye on special needs children.  They would like to record audio along with the video.  Is there any issue with doing this if it is on their private property here in Pennsylvania?  Would they have to notify every person that comes to their home?  Should they have signs posted stating that the cameras are recording audio?  They do have nurses and aids that assist them, should they have them sign a waiver acknowledging the fact that they are recording the video and audio?

    Your inquiry is a bit different that Alan's because you don't specify that your cameras and audio will be covert.  I am comfortable advising you that you can install the requested equipment.  Even if the equipment was covert I would be OK with the installation.  As I mention above, I would not suggest installing equipment in the aide's private bedroom or bathroom.  I would also suggest adding "Subscriber has been advised to use surveillance system lawfully".  
    These kinds of questions are going to become more and more prevalent as the cost of cameras and audio surveillance equipment continues to be more affordable, more available, easier to install, DIY and relatively cheap to monitor.
