33 L.P.R.A. § 4186 (2004)
§ 4186. Recording of communications
Any person who takes part in a private personal communication, be it by
telephone or by any other means, or any person extraneous thereto who records
said communication by any mechanical means or otherwise without the express
consent of all parties concerned in said communication, shall be punished by a
fixed term of imprisonment of five (5) years.
Should aggravating circumstances exist, the established fixed penalty may be
increased to a maximum of seven (7) years; should mitigating circumstances
exist, the penalty may be reduced to a minimum of four (4) years.
The court, at its discretion, may impose the established fixed penalty of
imprisonment or a fine which shall not exceed five thousand dollars ($5,000), or
both penalties.
