UNITED STATES BANKRUPTCY COURT
EASTERN DISTRICT OF NEW YORK
---------------------------------------------------------------X
In the Matter of Chapter 7
Case No. 803-86379-288
CUSTOM POWER SYSTEMS CORP, NOTICE TO CREDITORS
Debtor.
---------------------------------------------------------------X
TO ALL PARTIES IN INTEREST:
PLEASE TAKE NOTICE that, pursuant to Section 363 of the Bankruptcy Code and
Bankruptcy Rule 6004(a), the trustee, Kenneth Kirschenbaum, intends to sell to
Paul Alessandrini, his right, title and interest in various electronic parts,
testing equipment and inventory located on the debtor's premises, for the sum
of $24,000.00, subject to (1) any and all liens, encumbrances, claims and
other interests; and (2) higher or better offers. The property to be sold is
unencumbered, but ownership is disputed by the debtor and entities sharing the
premises with the debtor who claim that the subject property is not property of
the debtor. In order to resolve further dispute with the trustee, the sale
will include all property, subject to adverse claims.
The trustee has determined that the offer exceeds the value of the property.
An electronic's parts broker offered a fraction of the amount of the offer
to purchase the property, and an independent appraiser has advised the trustee
that the offer exceeds the appraised value of the property to be sold.
Therefore, the trustee believes the sale is in the best interests of the
creditors
of the estate.
The sale of the property, which is subject to higher or better offers, will
take place at the offices of the trustee, Kenneth Kirschenbaum, 200 Garden
City Plaza, Garden City, New York on November 3, 2004 at 11:00 a.m. The terms of
sale are as follows: $1,000.00 due at the time of sale, balance to be paid by
January 1, 2005.
Anyone interested in obtaining further details may call the trustee, 200
Garden City Plaza, Garden City, New York, at (516) 747-6700. The property may be
inspected or premises looked at on Monday, November 2, 2004 between 10 a.m.
and 12 p.m. .
Any objection to said sale must be in writing, filed with the Clerk of the
Bankruptcy Court, Long Island Federal Courthouse, 290 Federal Plaza, Central
Islip, NY 11722, and served upon the United States Trustee, Long Island Federal
Courthouse, 560 Federal Plaza, Central Islip, NY 11722, and upon the trustee,
Kenneth Kirschenbaum, so as to actually be received on or before 12:00 o'clock
noon on the 29th day of October 2004.
In the event objections are timely filed and served, a hearing to consider
the objections will be held before Judge Stan Bernstein, at the United States
Bankruptcy Court, Long Island Federal Courthouse, 290 Federal Plaza, Room 860,
Central Islip, New York on November 16, 2004, at 9:30 a.m. In the event that
no objections are timely filed and served, no hearing will be held, and an
order authorizing the sale may
be signed by the Court without any further notice, in which case the sale
will take place as scheduled herein, or as soon thereafter as is feasible.
