YARD SIGNS AND DECALS WITH NO ALARM

    We have a sales guy who has a habit of putting our Signs and/or Stickers on properties (mainly vacant) that are identified by our management company customers as properties where they may want an alarm system installed in but they have not been installed yet or even contracted for.   Is there liability to us in him placing the Signs and/or stickers prior to having a contract signed or the system installed?

    It's been a long time since I passed a vacant store and saw 10 or more alarm stickers on the window.  Maybe alarm sales people aren't pounding the pavement any more.  
    Your salesman isn't randomly placing signs and stickers; he's been sent to a vacant home by a management company; why I am not so sure.  Maybe they want a price for an alarm before they take it over. 
    Aside from the possibility that your employee is trespassing on property still owned by the soon to be homeless owner, who may still be home with his shot-gun at hand, I doubt that there can be any exposure.  Who could have any expectation that alarm services were being provided?  A squatter, trespasser, or neighbor?  I don't think so.  
    Feel free to place all the signs and decals you want in vacant homes.  Don't complain if you get ticketed for littering.

CONTRACT FOR MULTIPLE STATES

    I have a company that covers several states. I have done a couple of recent acquisitions and now have multiple contracts that I am working from. I have enjoyed reading your articles and am sure your firm can help with a standard contract moving forward. My concern is, do I need to have different contracts for every state or I can have one that covers a majority.

    Our Commercial All in One can be used in multiple states.  Our Residential All in One needs to customized for most states so we recommend a different contract for each state, with some exception.  A residential contract for multiple states would have to meet the requirements of both states.  The additional provisions to accommodate additional states will definitely lengthen the contract adding at least one page if not several.  If you are not using electronic contracts the paper form would be challenging to use.
