Question:

Hi Jennifer,

I am looking to procure a new lease for my practice.  The landlord has asked for my tax returns.  When is the right time for a confidentiality agreement?

Thanks,
Dr. F

Answer:

Dr. F, glad you flagged!  Prior to release of any non-public, proprietary information, where you have an anticipated or pending request outstanding is the right time to procure a confidentiality agreement prior to disclosure.  We are looking for any third party receiving proprietary data is bound by its care and treatment of same, and limited in its use, distribution and maintenance - all of which should be addressed in the confidentiality agreement sent for execution.
