Re Reply to Mike from Jan 5th 2012/Cable companies

Mike;

As a small alarm company owner I agree with you 100%. This industry we built has become a playground for the BIG money companies who win away our customers with promises that they never keep. I am a Time Warner Cable customer who is in the middle of a battle of BIG companies over pricing for MSG network, home of the Knicks and Rangers. But the issue here is that we as alarm company owners do not band together and fight back, we let the Big companies woo our customers away simply because they have the numbers to offer free systems and services.

I notice that the alarm industry does not advertise on TV like ADT, Slomins and the BIG companies do offering complete home and business protection for free, but no one reads the disclaimers or the contracts that they sign. If our trade organizations want our support and backing why are they not advertising and offering us, the little guys a chance to participate in a local advertising co op? Why don't you and I start a forum of our own to contact the little guys who we read about here on Ken's page?

I read this forum religiously and I have read the comments from others like us who have a lot to say. I would love to form a co op of companies that can advertise on local tv.

I would like to have someone on my team that wants to form a company that offers integration services to the public like I am now doing, only to lose the job to A BIG company that sugar coats the offer with a free camera you can see from your smartphone.

Elevator Contract

Ken

How would we go about getting the elevator contract, need to insure that this is in 'unlocked' format so we can edit/add logo/address etc. --- didn't want to order direct from site if this was not an option

Paul

************** Response - you order it here: https://www.kirschenbaumesq.com/alarm2.htm

Ken,

I just purchased your elevator contract and I don't understand what you mean by:

Communication Channel assigned for elevator to provide 24 hour communication: ______

Robert

****************** Response - it's the designated phone line assigned to the elevator. The elevator needs its own line so that it can be identified by caller id in case of emergency

Credit card company not final decision maker

KEN,

Is it at all possible to sue a client for damages, once they have had their merchant account (AMERICA EXPRESS) to refund them for products and services (6)month later, the client reason for demanding a refund to his account was Quote (The cardholder via their issuer is stating that the goods or services sold were returned or cancelled.) this statement is false.

The client purchase the system for his home and he did sign both the Remote Video Access Service Contract and the Notice of Cancellation Residential Form, the client also sign off on a notice of completion form that is generated by our company to provide additional verification that our client's acknowledge their satisfaction and or approval once a job has been completed.

If we can sue this client under what grounds and how much can we sue for?

**************** Response - the credit card company can reverse the charge, but you can still sue for your damages for the breach of contract. See the contract terms for the calculation of damages. It's going to be 80% of the contract balance.

Renewal contracts question

******************

Hi Ken,

Quick question, I was wondering if you had available a contact for existing clients to renew their contacts. I send out annual invoices for my clients and would like to send a contract with it, the one we did is for new clients only. Isn't there something that should go with this for existing clients or clients that renew after the 3 year initial contract? What do you advise?

Jeannie

Rather than messing around with a "renewal" contract you should get your subscribers to sign new contracts; then you get a brand new original term contract.
