Hi Ken-
I'm in the process of revising some of my contracts with existing customers using your forms I purchased some time ago. These are all fire accounts. Regarding item #5 Runner Service, according to your contract it is another advance payable fee. Miami Dade county recently passed an ordinance (2009) requiring runner service on ALL existing fire systems within the county, however it is still not being strictly enforced, ie. these are not UL accounts and the Fire Dept does not usually remain on site for an hour or wait until a runner arrives. As I am trying hard to keep customer costs to a minimum, I was wondering if it would be a good idea to write in the words "per call" for the pricing amount so that way we can still satisfy the ordinance which requires runner service in the contract and only charge for the occasional times when it is necessary to initiate a runner response call on a call-by-call basis.
Also, how would one best determine the "Runs per year" amount? If i were to pick a number, say 1 run per year, and want to increase that at a later date would I have to redo the entire contract?

Runner service is an AHJ requirement that the central station send a "runner" when dispatching an alarm. What a "runner" is expected to do, and how a "runner" is different from a "guard" who is providing guard response probably differs from jurisdiction to jurisdiction. Runner service was incoporated in the Standard Form Contract when an alarm company advised it was required in its jurisdiction. It seemed like a good idea to creat additional RMR so I decided to add the service to the Standard Forms.
As far as changing the form from RMR to per call, the great thing about being the draftsman of the contract is that you can change the terms to suit your model of doing business. So by all means you can go from RMR to per call on the runner service. Just keep in mind that per call doesn't generally add to your equity valuation. One change I think we need to make to the RMR for runner service is the limit on calls. Obviously you can't base the RMR on one call a month and then find you have 10. I suppose you can price it this way. Figure out the cost of one runner call. Say it's $50. Figure 6 per year, that's $300, payable monthly, that's $25 per month and the limit is 6 calls per year, after which the charge is $75 per call.

I have a question for Richard Moreau from CRN Wireless. Does he really believe that the only time a product needs to be listed and labeled, by a NRTL [National Recognized Testing Laboratory] is when the product is used in a UL certified commercial application? The powers to be, from this company, really need to revisit the NEC before the dealers buying the product get themselves into a jam. His comment was correct when saying that the product should not be used in a UL certified commercial application but neglected to say or maybe understand that the product should not be used in any application until it is listed and labeled by a NRTL. Many of the "systems" coming out today are being listed as such, "systems" or "assemblies" even for household applications. When a non listed product is used as a part of these "systems" or "assemblies" it can void the listing should it be found. (Usually during a law suit and expert witness testimony) Richard, read the NEC sections that refer to labeling, listing, approved and suitability of products and get back with us on your findings. Maybe an exemption statement from a NRTL would help your efforts and save the dealers a bunch of heartburn.

I am sure CRN Wireless can answer for itself, and it's welcome to do so. But I do want to point out that I suspect that the converter device is used in most cases for non listed residential accounts. An alarm company that is called upon to take over an alarm account for a listed system is going to have to ensure that the system is in full compliance and that is going to require access to the programming codes and passwords. So the converter device is really something that's not intended for that type of account. Am I wrong?
