Nassau County alarm law Subdivision 4 of section 8-40.8 provides:
"4. All residential alarm notifications must include an attempted telephone notification with two calls back to the residence or secondary number by the privately operated central station before the Police Department is notified."
This requires central stations to make a 2 calls prior to notification on residential alarms otherwise known as Enhanced Call Verification or "ECV". Numerous central stations have elected to ignore this part of the ordinance. Either because they believe that the subscribers will cancel service and elect self monitoring or they do not want to inform the end users of the real possibilities of false alarms and dispatches.
Could central stations be held accountable, in the event of an incident such as a police vehicle getting into an accident, or the injury of an authorized person on site, when responding to an alarm that was not properly vetted as required?

Nassau County's ECV requirement isn't unique. ECV is the law in many jurisdictions. Alarm verification, whether by multiple phone calls, video clips, audio activation or runner service all have the intended purpose of weeding out false alarms. For law enforcement, "false alarm" means there is no actual threat - i.e., intrusion; fire. I'm sure there are statistics that show that alarm verification reduces alarm notification and response. That means less false alarms.
Central stations are between a rock and a hard place when it comes to alarm verification. A subscriber facing a real emergency situation doesn't want to waste time waiting for a call to verify that someone is in the house or pushed their way into the store. The ADT commercial comes to mind. Guy breaks into the house and the woman gets a phone call and is told police are on the way. First, I don't want to be in bed, hear someone break in, the alarm go off, and wait to get a phone call. Second, why did the ADT dispatcher notify the police before verifying the alarm? Perhaps what should have been said to the subscriber is "I'll notify the police now that I've confirmed your emergency."
What are the stats for how long it takes for a homeowner to suffer injury or loss when there is a break in? Response time depends on where you live, and can take from 4 minutes to the next day or never. A few extra minutes will seem like a lifetime, which is exactly what it might be. Anyway, I'm sounding like a subscriber.
The central station is under contract with the dealer and the subscriber to report a signal. The contractual obligation can be worded in many ways, calling for "prompt", "immediate", "reasonable" response. Contracts rarely describe call verification requirements or procedure, although the contract could and should provide that the central station will comply with applicable law.
I think there are several potential areas of liablity. First is to the subscriber who expects police to be notified quickly. Of course subscribers with false alarms and false alarm fines will appreciate ECV with reduces or eliminates those fines, but delay in an actual emergency will negate all of that prior good will. Certainly the central station faces no additional exposure for complying with ECV as long as it does so quickly and there is no delay. The exposure for not complying would be the fine, which the contract and I believe all alarm ordinances requires the subscriber to pay. Unhappy subscribers make for unhappy dealers, so that's a consideration. A central station that blatantly ignores verification laws risks being cut off by the police.
Liability to others is another interesting issue. Emergency responders have sued alarm companies for causing a dispatch on a false alarm. Those cases generally are not successful because of the Police and Fireman's Rule, which, generally, provides that police and fire personnel can't sue for injury sustained in their performance of their job. An exception however is when a law has been broken. It will be interesting to see if a lawsuit is successful if the central station falied to comply with veriification and that imposes liablility.
