Jury trial about to begin in what could be the most impactful door-knockers case of our time - by Jesse Kirschenbaum, Esq

          The trial between Vivint and CPI Security, both major players in the industry, is expected to begin in February 2022.  In 2020 CPI sued Vivint claiming Vivint used deceptive sales tactics to steal CPI’s subscribers.  A jury trial scheduled to start in January was postponed to February due to coronavirus concerns.
          In its complaint, CPI alleged that Vivint’s sales reps regularly knock on CPI subscribers’ doors, mislead them into believing that CPI and Vivint have a business relationship and fraudulently induce the CPI subscribers into signing new, high priced, multi-year financing and monitoring contracts with Vivint after convincing the subscribers that Vivint is simply assuming their account or that they are receiving new CPI equipment. 
          CPI is seeking $50 million in damages, claiming that they’ve lost millions of dollars in business as a result of Vivint egregious conduct.   In response to CPI’s claims, Vivint denied all claims of deceptive sales tactics and also filed a counterclaim against CPI alleging that CPI defamed Vivint by sending notices to subscribers about Vivint’s “scams.”  Vivint eventually withdrew its counterclaim.  The trial is taking place in Charlotte, NC where CPI is based. 
          We’ll see if this case proceeds to a verdict or settles.
