All prior articles are posted on the K&K website under Alarm Articles: https://www.kirschenbaumesq.com/page/alarm-articles The FTC “negative option” rule does affect the automatic renewal provision that the alarm industry relies on in its subscriber agreements. On the side of caution and prudence K&K has updated the Standard Form Agreements to incorporate the news FTC rules. The FTC’s new “negative option” rule has officially been published in the Federal Register. The regulation will be effective as of January 14, 2025. With the change in administration coming end of January 2024 it remains to be seem if there will be a curtailing, pull-back or revocation of regulations issued by the 3 letter federal agencies, FTC and a bunch of others whose names I’d rather not even think of. I suppose rolling back to the year 1800 may be too much to expect or hope for when it comes to federal agencies and government, especially federal, oversight. Changing the automatic renewal provision added to the provision but didn’t really add any burdensome procedures; more or less how and when the contract automatically renewed and how and when the customer could cancel. The version 2024 K&K Standard Form Agreements are ready and they do include this new change as well has many others made during 2023. You should update your contracts, even if relatively new [and relatively new is subjective because some of you think 10 year old contracts are relatively new ….. update your contracts every two years …. And more often if there are changes in law or practice, which there is for 2024. Keep in mind that K&K updates are free for 6 months and half price for the first year.
