I turned this over our Licensing Department for response.  Here is Nicoletta Lakato's response:
Regarding licenses for the sale and monitoring of DIY systems, your answer will depend on how you plan on selling the system.  If it’s over the counter or online, there will generally be no license required.  However, if you plan on selling door-to-door or via telemarketing, you may need licenses for those activities specifically, and may also trigger an alarm license requirement in certain states.
The states which specifically require a license for monitoring are as follows. So, your answer is all states NOT on this list do not require an alarm license to monitor:   Alabama,  Arizona, Arkansas, California, Delaware, District of Columbia, Florida, Illinois, Maryland, Michigan, North Carolina, Oklahoma, Oregon, Rhode Island, Tennessee, Texas, Utah and Virginia.
Keep in mind that this is a state list.  There are municipalities that require a license, registration or certification.  Also note that every state with an alarm license has its own regulations and requirements.  For assistance regarding alarm licensing contact Nicoletta Lakatos,Esq at 516 747 6700 x 311 or email her at NLakatos@KirschenbaumEsq.com.
Regarding Texas, it has  separate Alarm Company and Fire Alarm Installer licenses. You won’t need a fire alarm detection / installation license if you’re only selling the smoke detectors over the counter or by mail order, and do not plan, certify, install, service or maintain the devices.  These activities are specifically exempt.  You will however need a monitoring license through the Department of Public Safety.

If you're going nationwide then you'll need the services of our licensing attorneys and you'll need our Nationwide Agreements.  These agreements are updated regularly to comply with all state jurisdictions so that you get the contractual protection you need to operate your alarm or PERS business.
The Nationwide All in One Agreements are for
Nationwide PERS
Nationwide DIY - security with monitoring
Nationwide DIY - home automation and integration
For more information on our Nationwide All in One agreements contact our Contract Administrator Eileen Wagda at 516 747 6700 x 312 or email her at EWagda@KirschenbaumEsq.com, or call me directly.

Ken
Try as you might to be a tough guy (or at least appear  that way), I am convinced that you are really a pussycat! For your readers, a little background. First, I'm a big KK fan. Anybody who has built what Ken has built, is an entrepreneur par excellent. He is a risk taker. He is a gambler. And he can also be a great friend. Over the years, we have become great friends.
We were talking on the phone last week, and I asked him if he had received a complimentary copy of my new book, THE START OF THE DEAL. It deals with all aspects of acquisitions, mergers etc. the things that Ken and I deal with daily. It was written with an eye to providing insights into that whole process to the average businessperson. The early reviews seem to indicate that it's going to do well. And then Ken asked me if there's anything he could do to help make it a success.  I told him that before we can really determine how good the book will do, we need to get some review,  preferably, from people who read Ken Kirschenbaum's newsletter. Within a few minutes Ken offered to mention the book in his newsletter, and before I knew it well over 100 alarm dealers took advantage of a free book offer that can put together for his readers. We win because we get feedback sooner than we would have. The readers of Ken's newsletter get a terrific book, free. Can gets some free publicity, although he jokingly offered to make sure that everybody understood the FREE book had a money back guarantee. We actually got one letter asking how we can guarantee something that didn't cost anything. What Ken did, saved me months of time, days of effort, and not a small amount of money.
Is he a good guy? You bet, he proved it to me. Now I'm going to get him to offer a free contract just to see how he feels about giving something that he prizes away for nothing. We'll see how that's goes. And the real hero in all of this is Eileen in KK's office. She handled everything, flawlessly. Ken, you are a industry treasure. Thank you.

RESPONSE

Ron, you are welcome.  Your book is worth reading and your love and enthusiasm for the alarm industry unparalleled.  And I must say that your energy is unmatched.  I hope everyone takes advantage of your FREE book offer and if you haven't then feel FREE to contact Ron directly and ask for the book.  His email is above.  Tell him it's on the KK promotion.
My only disappointment is that Ron hasn't offered to buy a Standard Form Agreement for everyone reading and offering a review of his book.  Now that would be a thank you.  What Ron probably doesn't realize is that the time he spent writing his book is probably very close to the time I put in drafting just one of the contracts offered on our Contract Order Form.  Unlike some other attorneys, I didn't just copy the form from someone else, make a few changes and peddle it as my own work of art.  If you need an alarm agreement, or need to update, please don't wait for Ron or I to buy you a free copy.  Order your contracts today; you'll save plenty tomorrow.  If you need assistance deciding which contracts are suitable for you, or you are accustom to VIP treatment [aren't we all] call our Contract Administrator Eileen Wagda at:
