Can email or PO substitute for contract

Ken
I have some large customers won't sign paperwork. They either issue a PO or just email back with my quote/agreement attached and say this job is approved.
Would this be acceptable or no way?

For installation only you may be able to get away with less; but for after-install work you must have your contract signed.  A return email attaching or referencing your contract MAY be enough, but I'd have to see exactly what the email says.  It should say the contract is approved.
Best practice, get your contract signed or dont do any work.
Without seeing what is in an email or a PO I cant opine if it’s sufficient to protect you.  Keep in mind that protecting you with the contract provisions is only one important aspect of the contract; creating equity for your business, adding value through the contract with the customer through RMR, will not be acceptable to a buyer of the accounts without a proper contract; that buyer will not accept a PO or email that is not very carefully drafted.
You will be called upon to do installation work using a contract presented by a GC or an owner who won’t sign your contract.  Under some circumstances that is going to be acceptable, though not preferable.
Once the installation is complete you should not perform any work, other than warranty work, without your contract being signed, whether that contract calls for RMR or per call payment.  The reason is that you simply will not have the contractual protection that you need.  Also be mindful that there is considerable difference between doing an installation for whatever the purchase price is and doing a single service call or inspection.  While the risk is just about the same the potential for profit is much different.
The bottom line is that you should do no work without getting your contract signed, and that contract should be an updated Kirschenbaum Contract.  Take advantage of the sale going on right now.
