Question:

Jennifer,

My contract expired a few months ago.  Am I still subject to the restrictions in the agreement?

Thanks in advance,
Dr. O

Answer:

Absolutely depends on the language in the agreement. Many agreements provide for certain restrictions to survive termination OR expiration of an agreement. If your agreement contains such provisions as related to certain restrictions, those provisions may have survived. Also, under certain circumstances restrictions may in fact be extended, depending on the agreement language. Your best bet for interpretation is having the agreement reviewed. Based on industry standard, it is very likely any restrictions in the agreement may extend.  Of course the grounds and execution of your termination may impact enforceability, potentially.
