Watch for the gifts for the next 8 nights from K&K – they will be delivered by the Mensch on the Bench. ************************** Can employer recoup training expense if employee leaves employment ************************** Ken Can your team can provide language for me to add to my company handbook (purchased from Ken this past year) to protect myself financially from the expense of required training such as OSHA and equipment lift certifications that we need for these larger jobs. We do not to mention the background checks and continued drug screening. I have worked at other companies and they have some loose terms such as “fees for training and certifications are to be repaid by employee if employment is terminated within 2 years”… something a little more professional though… We are doing a lot of high-profile jobs and the fees are piling up for people that just don’t last. JB **************************** Response **************************** The simply answer is that you can recoup training expense from employees who leave employ within a specified time after the training. There are some conditions and they may vary state to state, so K&K will have to check your state before providing the provisions in either the Handbook or Employment Agreement. The training needs to be for the employer’s purposes and benefit, which should be fairly easy to establish.
