JOSEPH LATONA, an attorney duly licensed to practice law
in the courts of the State of New York and admitted to practice
in the Eastern District, affirms the following to be true under
the penalties of perjury:
1. This firm represents Ford Motor Credit Company in
the within matter.
2. A copy of the proof of claim filed by this office on
behalf of Ford Motor Credit Company on March 21, 2002 is annexed
(exhibit A).
3. The proof of claim was in the amount of $8,955.52.
4. On or about March 17, 2004, a check in the
above matter was received from the Chapter 7 Trustee,
Kenneth Kirschenbaum. The original check is annexed as
exhibit B.
5. The check notes that it is void after 90 days. It was
misplace: in this office from March, 2004 until October 21, 2004
by which time the Trustee had stopped payment on the check and
had deposited the funds with the Bankruptcy Court as unclaimed
funds. In a telephone conversation with the Trustee, the fact
that payment had been stopped on the check was confirmed by an
employee of this office.
6. Accordingly, it is requested that the annexed order be
granted and the funds paid to Ford Motor Credit Company, care of
Rubin & Rothman, LLC, 1787 Veterans Memorial Hwy., P.O. Box
9003, Islandia, N.Y. 11749.
