Just what I know you love to hear from lawyers - additional areas of potential liability that should not be overlooked.
Oftentimes it is easy to forget about scenarios that do not present themselves on a regular basis. An example of such an instance is where a physician was held accountable for not providing reasonable accommodations to a deaf patient is a recent case in New Jersey where the "largest award" in the US, $400,000, was awarded to a deaf patient when the patient's treating rheumatologist treating the lupus patient repeatedly refused to provide a sign language interpreter. I will provide additional information on this case once/if an opinion is published. I am not aware of what sort of notice or requests this physician was presented with.
I wanted to send a quick email out about this award just to remind everyone that you must be aware of other potential areas of liability, not just malpractice. I will send out another mailing in a few days on disability accommodations offices are required to have, which is another area of potential liability that many offices overlook.
